Editors’ Letter
Dear Readers,
Women have gradually achieved leading working positions in the past decades and this is not different in the IP area. In our firm we nowadays amount to almost half of the partners and we proved to be pivotal for the success of our business.
It is definitely not easy to combine our multitasking roles as professionals, friends, mothers, sports practitioners, housewives and so many others. We have however bravely shown our power, multifaceted personality, knowledge and passion for our profession.
For this, once again, our 2019 Special Edition of our Newsletter was written only by the women in our team. Women that are passionate about what they do every day in a place where we are proud to say, equally offer chances and opportunities for the genders!
To celebrate WIPO’s chosen campaign for 2019, we will begin with an interview with a strategist in Personal Branding and Career Management who will bring a feminine approach about the world of sports.
Our first piece is about Fashion Law from a Brazilian perspective. We will then review some important and very recent decisions issued by the Court of Appeals regarding Suggestive Marks in the Pharmaceutical Field, Descriptiveness as a Defining Character of Registrability and the Cancellation of a Trademark Registration based on Bad Faith.
Further, we will discuss the Harmonization of Pharmaceutical Marks by the BPTO and the Health Surveillance Agency, Choosing a Trademark or a Plant Variety Protection Denomination, the reasons for registering Industrial Designs and Trademarks Nicknaming.
