Established under Ordinances GM/MDIC No. 110/2025 and INPI/PR No. 10/2025, the new fees and services schedule will come into effect on August 7, 2025. Following over a decade without adjustments, the average fees increase is 24%. New fees and services seek to align with international standards.

Key updates include:

Patents

• New fast-track examination categories: public interest or strategic justifications have been formally incorporated into patent procedures, alongside other preexisting fast-track programs.

• New services added: two new procedures have been formally introduced: waiver of Appeal and Waiver of Petition, both exempted from official fees, available starting on December 20, 2025.

• New structure for patent grant fees: final issuance fees will be eliminated. Patents and certificates of addition will be automatically granted in case of favorable examination, effective from December 20, 2025.

• Expanded eligibility for 50% and 100% discounts: now available to individuals, micro and small enterprises, nonprofit organizations, certain academic and public institutions, among others. In co-ownership, all applicants must be eligible.


Trademarks

• New fast-track examination: strategic or public policy reasons, ongoing court disputes and other special cases.

• New services added: possibility to claim acquired distinctiveness during trademark prosecution, starting on December 20, 2025.

• Lower fees: for non-Madrid Protocol trademark applications using pre-approved product/service descriptions under the Nice Classification.

• New structure for registration fees: fees for filing, registration, ten-year Protection term, and issuance of the certificate are now combined into a single payment at the beginning of the prosecution, effective September 20, 2025.

• Expanded eligibility for 50% and 100% discounts: same as in Patents.


Contracts

• New services added: recordal of amendments and requests for scanned copies.

• New structure for fees: requests for cancellation and shelving of a recordal process are no longer free of charge. The fees for requesting changes in the certificate of recordal were reduced.


While certain fees will increase, the revised schedule attempts to simplify procedures, seeking to minimize indirect costs, and enhance overall transparency and predictability. On the other hand, the new structure and new services may call for more strategic decision-making and careful consideration of available benefits.
