Argentina Patent System Reform: PCT Accession and Life Sciences Impact

On February 5, 2026, Argentina and the United States signed an agreement on reciprocal trade and investment, establishing a framework that aligns Argentina's trade policies and intellectual property standards with international norms. This agreement includes broad trade facilitation measures and reduction of tariffs, the implementation of multiple IP-related international agreements and the modernization of regulations benefiting global businesses. 

The agreement contains key intellectual property provisions. Argentina will submit the Patent Cooperation Treaty (PCT) to its Congress for a vote by April 30, 2026. In addition, several restrictive Joint Resolutions — 118/2012, 546/2012, 107/2012, and 283/2015 — are to be repealed, allowing broader patent protection for pharmaceutical and biotechnology inventions. Accession and the lift of such restrictions would significantly affect filing strategies and international patent portfolio management involving Argentina. 

Other treaties (such as the UPOV 1991 Act) and enhanced protection for geographical indications are also considered in the agreement, along with measures aimed at creating a more robust IP enforcement environment. Including the introduction tougher penalties for infringement, criminalize online piracy, reduce or compensate for patent delays with patent extensions, and ensure cooperation between ISPs, rights holders, and enforcement bodies.
