The BPTO published Ordinance No. 26 stating that it will be possible to accelerate the prosecution of Brazilian patent applications through a PPH procedure and the limit is now of 800 requests every three months.

On December 24, 2024 the BPTO published Ordinance No. 26 stating that it will be possible to accelerate the prosecution of Brazilian patent applications through a PPH procedure and the limit is now of 800 requests every three months.

As a result, it will be possible to expedite the prosecution of batches of 800 applications as of January 1, 2025, April, 1, 2025, July 1, 2025 and October 1, 2025, respectively, amounting up to 3.200 PPH requests per year.

The same ordinance states that it will not be possible to request an accelerated procedure under PPH for applications with a main classification IPC H04 (ELECTRIC COMMUNICATION TECHNIQUE) for the first batch beginning on January 1, 2025. The BPTO will review the program every three months with regard to specific classifications that may be excluded from PPH requests.
