As per Brazilian PTO Guidance No. 13/2023, published on December 16, 2024, users can now utilize advanced electronic signatures to access services and interact with the BPTO through their local representatives. This includes signatures with certificates not issued by the local authority (ICP-Brasil) or other methods that prove document authorship and integrity.
The only exception are services related to computer programs and integrated circuit topographies.
In practice, the BPTO will now accept digital signatures from foreign platforms, which was previously not allowed due to the exclusive requirement of ICP-Brasil. Ink signed documents are no longer necessary but, in this case, notarization and consular legalization remain necessary.
This change represents a significant advance in simplifying processes and reducing bureaucracy.
