Brazilian general data protection law in force
The Brazilian General Personal Data Protection Law - LGPD (Law No. 13,709/18) came into force today (September 18, 2020), as a result of the presidential sanction to Law No. 14,058/20.
The administrative penalties of the LGPD cannot be enforced before August 1st, 2021, pursuant to Law No. 14.010/20. However, consumer protection agencies may now monitor compliance with the LGPD and apply sanctions derived from other laws such as the Consumer Protection Code.
Our office has a dedicated team which provides a full range of legal services on privacy and personal data protection, including acting as data protection officers (DPOaaS). For companies that have not yet started their compliance programs, we have developed an emergency package that yields quick results in the short term.
